Terms and Conditions – Peaceful Films Inc.

These Terms and Conditions ("Terms") govern your use of the website and services provided by Peaceful Films Inc. ("we", "us", "our"). By accessing our website or booking services, you agree to be bound by these Terms.

1. Services Offered

Peaceful Films Inc. provides professional photography and videography services for real estate, commercial, and personal use. All services are subject to availability and confirmation.

2. Booking, Payment, and Service Fees

• Payment Terms: Invoices are due within 7 days of delivery. Late balances may incur a 2% monthly charge. HST applies. If deposits are requested for large/complex shoots, work begins once the deposit is received. We accept Stripe/credit card and QuickBooks/Interac e-Transfer.

• Standard Turnaround: Delivery for photos is 24–48 hours; video is typically 48–72 hours (for package clarity). Rush delivery options are available (fees apply).

• Travel & Parking: Services booked within the Kitchener-Waterloo core (or within a 20 km radius of our base) are included. Locations outside this area are billed at $0.65/km round-trip. Paid parking, tolls, site permits, and access fees are billed at cost.

• Archiving & Hosting: Media is archived by Peaceful Films Inc. and will not be deleted except by court order. Re-delivery links are available upon request. Media hosting is guaranteed for a minimum of 12 months.

3. Scheduling, Access, and Cancellations

• Readiness & Access: The client must ensure the property is clean, staged, and accessible at the scheduled time (lockbox/code ready, utilities on, pets secured).

• Waiting/Assist Time: If the home is not ready upon arrival, waiting or on-site assist time is $50/h after a 15-minute grace period. Crew cannot move heavy furniture or handle valuables.

• Late Cancellation / No Access: Rescheduling is free until 24 hours prior to the appointment. Cancellations made within 1 hour of the appointment, or if we are turned away or locked out on-site, a $50 late-cancellation fee applies.

• Re-visits: Second visits required due to client issues (e.g., missed appointment, HOA time windows, or access issues) are billed as an additional call-out fee.

• Permits / HOA / Building Rules: Client is responsible for obtaining any required filming/photography permissions and advising building/concierge/HOA in advance.

4. Media Content Specifics

• Revisions: One reasonable edit pass within 24 hours of delivery is included (stills or video). Additional revisions are billed at $60/round (stills) or $90/round (video). Edits requiring re-shoots are quoted separately.

• Weather, Drone & Safety: All drone flights comply with Transport Canada rules and local airspace. Weather and site safety determine what is possible on the day. If conditions prohibit drone flight, we will substitute ground/aerial-style looks or reschedule the aerial portion at no charge.

• Twilight: On-site twilight is weather dependent. If skies don't cooperate, the client may choose a no-charge reschedule or use day-to-dusk conversions of daylight images. (Two day-to-dusk conversions are typically included in standard photo packages).

• 3D Tours & Floor Plans: Scans reflect accessible areas only. Square footage and plans are generated by the platform provider for marketing purposes and should be verified by clients for brokerage/compliance needs. Inaccessible, locked, or unsafe areas are excluded.

5. Intellectual Property and Usage Rights

• Copyright: Peaceful Films Inc. retains copyright to all media created.

• Licensing: Clients receive a non-exclusive, non-transferable license (marketing rights) for the active listing (MLS, web, social, print) and their brand during the active listing term.

• Prohibited Use: Resale or transfer of media (e.g., to stagers, builders, new agents, or vendors) or use on future listings/third-party ads requires a separate written license.

6. Client Responsibilities (General)

• Cooperation is required to ensure safety and efficiency during the shoot.

• We do not move heavy furniture or handle valuables. We are not responsible for items left visible or for site conditions beyond our control.

7. Privacy and Cookie Consent

Use of our website is governed by our Privacy Policy, which includes our cookie consent practices. We use a cookie consent banner to ensure non-essential cookies (e.g., analytics, marketing) are only loaded after user acceptance, in accordance with Canadian privacy regulations.

8. Limitation of Liability

Peaceful Films Inc. is not liable for:

• Any indirect, incidental, or consequential damages

• Loss of data, revenue, or reputation

• Technical failures or delays beyond our control

9. Indemnification

You agree to indemnify and hold harmless Peaceful Films Inc. from any claims, damages, or liabilities arising from your misuse of our services or breach of these Terms.

10. Force Majeure

We are not liable for delays or non-performance due to events beyond our reasonable control, including but not limited to severe weather, outages, emergencies, airspace closures, or technical failures.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, they shall be subject to the jurisdiction of the courts of Ontario, Canada.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of the revised Terms.
